Items Required to Be Reported to or Approved by the Commission

All brokerages, all licensees and all Approved Sales Corporations are responsible, per the Commission’s Bylaw, for reporting certain items to the commission. View the Commission’s Bylaw.

ALL LICENSEES

All licensees are responsible to, unless otherwise indicated, immediately notify the Registrar in writing when:

WhatAccording to Bylaw
their name changes, within five days of the change 340(a)
their personal phone number changes, within five days of the change 340(b)
their home address changes, within five days of the change 340(b)
their email address changes, within five days of the change 340(b)
they are disciplined by a real estate association or any other professional or occupational regulatory body 334(a)
they have any judgment(s) rendered against them in relation to a trade in real estate, fraud or breach of trust 334(b)
any business the licensee owns or has participated in as a director or officer, has any judgment(s) rendered against the business in relation to a trade in real estate, fraud or breach of trust 334(c)
a licensee is the subject of any bankruptcy proceedings 334(d)
any business owned by a licensee, or is a director or officer of, is the subject of any bankruptcy or receivership proceedings 334(e)
a licensee is convicted of any criminal offence or any other offence under the law of any country, province or state, excluding provincial or municipal highway traffic offences resulting in monetary fines only 334(f)
they are going to be represented by counsel in a Commission hearing, at least five days prior to 826(a)

BROKERAGES

Brokerage are required to receive approval from the Registrar for:

WhatAccording to Bylaw
a new brokerage’s name or any amendment to a current brokerage’s name 307(a)
the design of the brokerage real estate sign (lawn sign) 307(d)
the design of the brokerage office advertising signage 307(d)

Brokerages are responsible to immediately notify the Registrar in writing of:

WhatAccording to Bylaw
the termination or resignation of the broker or any managing associate broker, associate broker, salesperson or approved sales corporation who is licensed with the brokerage (this includes those moving brokerages) 339(a)
an licensee changing from one branch office of a brokerage to another 339(b)
a change in the address, phone number or email address of the brokerage’s business office or branch office registered with the Commission 339(c)
a change in the bank in which the brokerage maintains a trust account 339(d)
a change in the partners if the brokerage is a partnership 339(e)
a change in the directors or officers of a corporation if the brokerage is a corporation 339(f)

BROKER AND ASSOCIATE BROKERS

Brokers and managing associate brokers are responsible to notify Registrar in writing:

WhatAccording to Bylaw
if a license of the brokerage is appointed in their temporary absence to have signing authority for the brokerage for the purpose of salesperson licence applications and terminations of licenses. All requests for signing authority must be accompanied by a sample signature from the designated licensee 341
if they appoint the managing associate broker(s) of the brokerage’s branch office(s) to have signing authority for all matters pertaining to that branch office. Notification of this delegation must be accompanied by a sample signature from the designated managing associate broker 342
if a director or broker of a brokerage files for bankruptcy, within five (5) days of filing 616
when applying for a new brokerage, the intended brokerage name to the Registrar prior to applying to the Registry of Joint Stocks 313A
lawsuits  

APPROVED SALES CORPORATIONS

Approved Sales Corporations are required to receive approval from the Registrar for:

Their Approved Sales Corporation name upon registering 313A

Approved Sales Corporations are responsible to notify the Commission with:

WhatAccording to Bylaw
a change of its name, within five days of the change 340A(a)
a change of its phone numbers or registered office, within five days of the change 340A(b)
a change in the Responsible Licence Holder, within five days of the change 340A(c)
a change in its Officers or Directors, within five days of the change 340A(d)
any change in issued shares or of the shareholders of the Approved Sales Corporation 340A(e)
