About the Nova Scotia Real Estate Trading Act

The Nova Scotia Real Estate Trading Act (the Act), created in 1997, consolidated and replaced the Real Estate Brokers Act and the Real Estate Assurance Fund Act. The Act establishes the Nova Scotia Real Estate Commission as a corporate body and transfers the responsibility of real estate regulation from the provincial government to self-regulation by the Commission.

Under the Act, legislative authority remains with the Minister, but the rules and standards for real estate brokerages and Industry Members, commercial leasing, and business brokerage are defined and administered by the Nova Scotia Real Estate Commission, except for those matters specifically exempted by the Act.
